BauBau is a digital platform that connects construction Servicers with construction work. Servicers can be construction workers, painters, carpenters, drivers, excavators,  masons, and crane drivers... Most often, the clients are construction companies that need Servicers, and they can also be private individuals.

The platform enables the joining of these two groups of users, communication, order tracking, invoicing, and everything else that is needed for the best performance of work. An example of work is the construction of a wall, painting works of that wall, finishing, and similar. The digital part of the platform consists of a website for desktop and mobile devices, an Administrator and Dispatcher panel, a panel for companies and drivers, 2 mobile applications for iOS and Android, one application for job senders, and the other for Servicers. The operational part of the platform is a company that enables the business to be carried out according to all legal and accounting regulations. The goal of the BauBau platform is to optimize and make construction works more efficient. It brings transparency, accountability, speed, and quality to the construction industry.

In order to do this, we need to collect information about you and about the order work. This policy tells you what information we collect and how we use it. We do not store information that we don’t have to.

We encourage you to read this Privacy Policy periodically to stay informed. We will make changes as needed, and updates will be reflected here. As long as you use the BauBau Platform, you are agreeing to this Privacy Policy.

With the following information, we would like to give you an overview of the processing of your personal data within the scope of the installation and usage of the “BauBau” platform (hereinafter referred to as the platform) and your rights to data protection laws. Please read our privacy policy carefully to get a clear understanding of how we collect, use, protect or otherwise handle your Personally Identifiable Information in accordance with the platform.

If you do not agree with any provision of this Privacy Policy, please do not continue using our platform. Your continued use of this platform, i.e. accessing its contents and/or using related services that we additionally provide, will be considered acceptance of this Privacy Policy.



 

1.0. PROCESSING OF PERSONAL DATA

In accordance with the Law on the Protection of Personal Data of the Republic of Serbia ("Official Gazette of the RS", No. 87/2018 - hereinafter: the Law on the Protection of Personal Data), personal data is any data relating to a natural person whose is an identity determined or determinable, directly or indirectly, especially on the basis of an identity marker, such as name and identification number, location data https://aws.amazon.com/.

In the case of a legal obligation, we reserve the right to disclose data about you to competent state authorities, all in accordance with Article 12 paragraph 1 point 3 of the Personal Data Protection Act, which stipulates that processing is legal if it is necessary to comply with the legal obligations of the handler. 


 

2. COLLECTION AND FURTHER PROCESSING OF PERSONAL DATA WHEN VISITING OUR PLATFORM


 

 2.1. INFORMATION WE COLLECT ABOUT YOU.

All information that we collect is to help better connection and communication between the Servicers and customers who ordered the work.

We may collect personal information that can identify you such as your name and email address and other information which can’t identify you, all for analytical data to help us improve the service. When you provide personal information through our platform, the information may be sent to servers hosted on the Amazon cloud network AWS (https://aws.amazon.com/). All database services are also hosted and managed by Amazon using Amazon RDS (https://aws.amazon.com/rds/mysql/).

We may collect and store any personal information you enter on our platform or provide to us in some other manner. This includes identifying information, such as your name, address, e-mail address, telephone number, credit card information, work license, licenses for work on a crane, or with roller machines, driver's license and other personally identifiable information.

 

2.1.1.  From You

Customers: As a Customer (person or construction company) you provide information, including your name, phone number, and email address. We will collect payment information, such as a credit card or other payment method to facilitate payment for the Platform. All such payment information and payment is handled by a secure third party, currently Stripe (stripe.com). To keep your information secure, we do not store complete credit card information on the Platform's servers. You may contact us directly, in which case we have the contact information contained in the correspondence.

Workers/Servicers: If you apply to become a Servicer, you will need to provide your contact information as well as more detailed information about you that we share with secure third parties, including your date of birth, physical address, Social Security number, driver’s license information, (vehicle information, car insurance information), and possibly other information. We share this information with partners who help us complete background checks on Servicer applicants. We will collect information from you about your bank account or other payment information so that we can pay you. We will collect tax information so that we can comply with applicable tax laws. The information you provide for financial transactions is shared with Stripe (stripe.com). The Platform does not store your personal financial data.

Cookies: We collect information through the use of “cookies”, tracking pixels, and similar technologies to understand how you navigate through the Platform and interact with BauBau. We may use both session cookies and persistent cookies. You can consult your web browser(s) to modify your cookie settings. Please note that if you delete or choose not to accept cookies from us, you may be missing out on certain features of the Platform.

 

2.1.2. From Third Parties

The Platform works with partners to complete background (criminal and driving) checks on Servicer applicants. If you apply to become a Servicer, these partners will provide us with information about you, such as your driving record or criminal history. If you register for the Platform using your account with a third party service (such as Facebook), we may receive information similar to what we collect from you as listed above. We may receive information about you from other parties and partners as may be helpful for payment, fraud prevention, or service.

 

2.2. INFORMATION SHARING

The Platform may send you notifications, emails, and messages significant to our service (for example Service achievement progress). The Platform also may send you updates about the Platform upgrades.

In certain circumstances, we may share the information we collect with third parties without further notice to you, unless required by the law, as set forth below: Third Party Service Providers. The Platform may allow you to connect with other websites, products, or services that we do not have control over (for example, we may give you the ability to order packaging materials from a third-party supplier). If you use these services, we will provide the third party with information about you to allow them to provide the service to you. We do not know the privacy practices of these third parties, and we encourage you to read their privacy policies before deciding whether to use their services. We work with third-party service providers to perform services on our behalf, including financial and security services, and we may share your information with such service providers to help us provide the Platform, including all of the things described above. Financial transactions are conducted through a trusted third-party provider, and financial information, including your credit card information, is not stored on the Platform’s servers. We take commercially reasonable steps to ensure our service providers adhere to the security standards we apply to your information.

If you access the Platform through an integration with a third-party service, we may share information about your use of the Platform with that third party. We may share your information with our third-party partners in order to get more information about you or create offers for you.

The Platform may also share your information with third parties in the following circumstances:

You consent to the sharing;

With our insurance partners to help determine relevant coverage;

To provide information about the use of the Platform to potential business partners, including while negotiating or in relation to a change of corporate control such as a restructuring, merger, or sale of our assets; or

2.4. USE OF COOKIES AND OTHER TECHNOLOGIES TO COLLECT INFORMATION.

We use various technologies to collect information from your computer and about your activities on our site.

Information is collected automatically. We automatically collect information from your browser when you visit our platform. This information includes your IP address, your browser type and language, access times, the content of any undeleted cookies that your browser previously accepted from us, and the referring platform address.

When you visit our platform, we may assign your computer one or more cookies, to facilitate access to our site and to personalize your online experience. 2.5. PLATFORM ANALYTICS (GOOGLE ANALYTICS) 

This platform uses Google Analytics, a service of the company Google ("Google") for the analysis of internet pages. Google Analytics uses a specific type of cookie that is stored on your computer and enables the analysis of your use of our platform. Information about your use of this platform, which is generated by cookies, is usually sent to a Google server in the United States of America.

We also use other cookies to personalize content and marketing, provide media features, and analyze the site traffic.

This platform uses Google Analytics to analyze the flow of visitors regardless of the type of device, based on the user identification number (ID). You can disable the tracking of your use of multiple devices in your Google account in the "My information" section, "Personal information".

As a legal basis for the use of Google Analytics, we use our legitimate interest in accordance with Article 12 paragraph 1 point 6 of the Personal Data Protection Act.


 

3. PROCESSING METHODS, LEGAL BASIS FOR PROCESSING, AND CATEGORIES OF PERSONAL DATA PROCESSED

 

Your Data is processed without, but also with, electronic means, based on logic and procedures that are in accordance with the goals stated below and in accordance with the Personal Data Protection Act, including the confidentiality and security of the Data. 

 

3.1. ONLINE (INTERNET) FORM

Through the form, you provide us with information about your project (such as project description, answers to standard additional questions, attachments (drawings, sketches, references), the deadline for project completion), and contact information (name, phone number, and e-mail address). The online form is adapted to the category and type of request you submit. When submitting a request, we invite you to familiarize yourself with the terms of use and privacy policy. When submitting a form on our platform, our hosting service provider stores the time and date of registration of the IP address from which the registration was made.

 

3.2. BASIS OF PERSONAL DATA PROCESSING

The Platform will process data based on the following legitimate grounds:

·         Your consents;

·         Fulfillment of legal obligations.

We do not process your personal data for any other purposes that are not mentioned in this document or are necessary for the provision of services in accordance with a legitimate interest.

Always subject to applicable laws and regulations we deliver your data exclusively to verified business entities whose activities are in line with your service needs.

 

3.3. CATEGORIES OF PERSONAL DATA WE PROCESS

We collect several categories of personal data, in several different situations.

If you decide to contact us by e-mail or by phone, we collect the following personal data, which are also collected when filling out the online form:

·         Your contact information: name, phone number, and e-mail address;

·         details of your project;

·         additional optional information about the project that you voluntarily provide.

We do not collect special categories of personal data, such as data about your race, ethnicity, political opinions, religious or philosophical beliefs, or trade union membership, nor do we collect your genetic or biometric data, data about your health, or data about your sex life or sexual orientation.

 

 

4.0. TRANSFER OF YOUR DATA TO THIRD PARTIES

 

4.1. WITH WHOM WE SHARE YOUR INFORMATION

We want you to understand when and with whom we may share personal or other information we have collected about you or your activities on our website or while using our services.

 

Personal information. We do not share your personal information with others except as indicated below or when we inform you and give you an opportunity to opt-out of having your personal information shared. We may share personal information with:

 

ü  Authorized service providers: We may share your personal information with our authorized service providers that perform certain services on our behalf. These services may include fulfilling orders, processing credit card payments, delivering packages, providing customer service and marketing assistance, performing business and sales analysis, supporting our platform functionality, and supporting contests, sweepstakes, surveys, and other features offered through our platform or performing background checks of Service Professionals. We may also release information to collection and/or credit agencies for past-due Service Professional accounts. These service providers may have access to personal information needed to perform their functions but are not permitted to share or use such information for any other purposes.

ü  Marketing Affiliates: When you are referred to us via a third-party marketing affiliate, we may share your email address or phone number, and other information that you provide, to such marketing affiliate.

ü  Business partners: When you make purchases, reservations, or engage in promotions offered through our platform or our services, we may share personal information with the businesses with which we partner to offer you those products, services, promotions, contests and/or sweepstakes. When you elect to engage in a particular merchant's offer or program, you authorize us to provide your email address, phone number, project order and other information to that merchant.

ü  Service Professionals. We match your information and service request against our list of Service Professionals. When you submit a service request through our platform, you consent to our providing your personal information and request to the Service Professionals we match with your request. Sharing this information with Service Professionals allows them to contact you using the e-mail address or other contact information you provided. ü  Direct mail partners. From time to time we may share our postal mailing list with selected providers of goods and services that may be of interest to you.

 

·         Other Situations. We also may disclose your information:

ü  In response to a subpoena or similar investigative demand, a court order, or a request for cooperation from law enforcement or other government agency; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law. In such cases, we may raise or waive any legal objection or right available to us.

ü  In connection with a substantial corporate transaction, such as the sale of our business, a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy.

 

5. PERIOD OF DATA STORAGE

The operator stores the data for the time period necessary to achieve the goals for which the data were collected and in accordance with applicable laws and regulations.

We keep the personal data that we process in the archive of the Platform, based on your consent, as long as it is necessary to perform the service. Also, we can keep the personal data longer for some other reasons, for eventual new services in the future, or for some legal requirements. In case of security withdrawal, we delete the data as soon as reasonably possible. If consent is given for a specific period of validity, the data is deleted after the expiration of that period of validity in the shortest, reasonably possible time.

In case would like us to remove your data, you would need to contact us and emphasize that directly.

Personal data that we process on the basis of legitimate interest is kept as long as there is a legitimate interest that is assessed on the basis of the legitimate interest test.
